WOJTYCZKA is an Internet Store, available at the domain Wojtyczkapantofle.pl , run by the company Tuptuś Wojciech Wojtyczka with its registered office at ul. Waksmundzka 212, in Nowy Targ (34-400), REGON:120701570, NIP: 7352801234, also referred to as the “Seller” in the further part of the Regulations. E-mail address: Wojtyczkapantofle.pl@gmail.com

I. General provisions.

1. Shipping of ordered goods in the WOJTYCZKA Internet Shop is carried out throughout the world.
2- Prices in the Online Store are expressed in Polish zloty and are gross prices.
3. orders can be placed through the website available at the domain Wojtyczkapantofle.pl.
4 The price shown next to the product at the moment of placing an order by the Customer is binding for the parties to the transaction.
5 At the moment of placing an order by the Customer via the Internet and accepting the order for processing by the Internet Shop, an order number is generated. The Customer is notified of this fact by e-mail. The Customer is also informed of the fulfilment of the order by e-mail.
6. All goods in the WOJTYCZKA Internet Shop are new and free from physical and legal defects.

II. Conditions of making purchases.

1. Orders for goods can be placed only via the website Wojtyczkapantofle.pl and through other online services provided by the manufacturer.
2. filling in the Order Form is a necessary condition for placing an order in the system of the On-line shop. . It is necessary to provide name and surname, contact details and e-mail address to which a confirmation of order acceptance and fulfilment will be sent (“Order Form”).
3. The Customer who has correctly filled in the Order Form and placed an order is a Buyer within the meaning of these Regulations.
3a. The provisions of these Regulations apply to both Customers who are Consumers and those who are not, unless the content of individual provisions indicates that they apply only to Customers who are Consumers, subject to point 3b.
3b. The provisions of the Terms and Conditions concerning Consumers also apply to customers who are natural persons conducting business activity, who conclude a sales agreement with the Seller or any other agreement under these Terms and Conditions, and which are not directly related to their business activity.
4. Acceptance by the Online Store of each order placed is confirmed by e-mail by the Online Store staff.
5. The Seller reserves the right not to accept for fulfilment incorrectly or partially filled Order Forms, the defects of which prevent the execution of the order for the Buyer.
6. Orders can be placed 24 hours a day, except for short breaks in the service of the Online Shop.
7. Orders placed on Sundays and holidays will be accepted for execution on the first working day following the day on which the order was placed.
8. The Buyer may cancel the order until the goods are dispatched. The Buyer will be informed by e-mail about the dispatch of the goods. The cancellation of the order can be made by contacting the telephone numbers indicated on the website Wojtyczkapantofle.pl/contact – contact to the Online Store, or at the e-mail address: kontakt@wojtyczka.biz The e-mail should be titled: “Cancellation of order no…” Cancellation of an order placed by the Customer will be effective if it reaches the Online Shop before the shipment of the ordered goods. The cancellation may concern the whole order or its part. . If the payment for the ordered goods was made in advance, the payment will be refunded within 7 working days to the account of the Buyer.
9. The Seller may offer an extension of the order lead time, to which the Buyer may agree. The buyer may withdraw from the contract.
10. The prices listed next to the goods offered do not include information on shipping costs.
11. The total price of the goods with information on shipping costs (if any) will be shown in the summary of contents in the Order Form. 12. Each shipment is accompanied by a proof of purchase.
13. In order to receive an invoice with the delivered goods, the Buyer is obliged to provide all the necessary data for its issuance.
14. The Seller shall provide the Buyer with a confirmation of the conclusion of the agreement at a distance on a durable medium no later than upon delivery of the ordered goods. The confirmation shall include: a) an invoice, b) an extract from these terms and conditions, which includes in particular: the information referred to in Article 12, Paragraph 1 of the Act on Consumer Rights.

III. Time and form of order processing.

1. Goods ordered in the Online Store are delivered via a courier service or by post.
2. The online shop gives the time of dispatch of the order as a term, which is given in days in accordance with the Civil Code. This is the time counted from the moment the order is accepted for fulfilment, through the transfer of the order for dispatch by the courier service, to the day of delivery of the goods to the Buyer. The order will be delivered to the address indicated in the Order Form immediately, no later than within 30 days.
3. In order to avoid disputes, the Seller informs that if the Buyer chooses the method of payment by prepayment (fast, standard and credit card transfer), the time of delivery of the order is counted from the day of crediting the Seller’s bank account.
4. If the Customer chooses to pay by prepayment at the time of purchase, the Customer undertakes to deposit the funds immediately into the Seller’s bank account. If the payment to the Seller’s bank account is not made within 3 days from the day of placing the order in the Online Shop, the order is cancelled. It is assumed that the day of payment is the day on which the Seller’s bank account is credited.

IV. Method of payment.

1. The payment for the placed order can be made:
a) by the courier upon collection of the consignment (so-called cash on delivery).
b) by prepayment (payment by bank transfer), including through the Przelewy24 system.
2. for orders with collection at the company’s premises, we prefer payment in cash, including via the Przelewy24,Paypal system or by traditional transfer.

V. Delivery costs.

1. Delivery is carried out in Poland and outside the borders is carried out for the safety of the shipment and convenience of the Buyer through the post office, courier service or parcel machine system.
2. the Buyer shall be charged with the costs of delivery in the amount of PLN 13.99. 

VI. Returns (Withdrawal from the purchase contract).

1. The consumer purchaser has the right to withdraw from the purchase contract within a period of 14 days without stating a reason and without incurring costs by submitting a declaration to this effect in writing. . Sending the declaration before the expiry of the deadline shall be sufficient to meet the deadline.
2.The period for withdrawal from the contract shall begin upon taking possession of the goods by the consumer or a third party indicated by the consumer.
3. declaration of withdrawal from the contract The consumer may submit a declaration of withdrawal by completing the appropriate Form “Declaration of withdrawal from the contract concluded at a distance” constituting an attachment available on the website of the Internet Shop, sending the signed Form together with the goods to the postal address of the Internet Shop. The company WOJTYCZKA ( TUPTUŚ WOJCIECH WOJTYCZKA ) kindly asks its Customers to use the above-mentioned Form “Declaration of withdrawal from a contract concluded at a distance” available at: https://Wojtyczkapantofle.pl/dostawa-i-zwroty or, in the case of any other form of notice of return, include in it all the information contained therein. Please send the returned goods to the address of the registered office: Tuptuś Wojciech Wojtyczka, 212 Waksmundzka Street, 34-400 Nowy Targ, marked “RETURN”.
4. ) A return as referred to above is only permitted for goods in an unaltered state, unless the change was necessary within the limits of ordinary management. The return may only be made in the original packaging. The goods should be duly protected.
5. The Seller shall, not later than 14 days from the date of receipt of the consumer Buyer’s declaration of withdrawal from the contract, return to the Buyer all payments made by the Buyer, including the costs of delivering the goods to the Buyer. The Buyer is obliged to return the item to the Seller immediately, but no later than 14 days from the day on which he or she withdrew from the contract. . To meet the deadline it is sufficient to send the item back before its expiry.
6. The Seller shall refund the payment using the same method of payment used by the consumer, unless the consumer, at the request of the Seller, has expressly agreed to a different method of return that does not involve any costs for him.
7. The Seller may withhold reimbursement of the payment received from the consumer until it has received the item back or the consumer has provided evidence of its return, whichever event occurs first.
8. The consumer shall be liable for any diminution in the value of the thing resulting from the use of the thing beyond what is necessary to ascertain its nature, characteristics and functioning.
9. When the consumer withdraws from a distance or off-premises contract, the associated ancillary contracts concluded by the consumer shall be terminated if, on the basis of those contracts, performance is provided by the trader or a third party on the basis of an agreement with the trader. The consumer shall not bear the costs related to the termination of these contracts, except for the costs referred to in Articles 33 34 2 and 35 of the Consumer Rights Act. If the ancillary contract has been concluded with a third party, the Seller shall inform that person of the consumer’s withdrawal from the contract.

VII. Conditions for complaints. Out-of-court ways of dealing with complaints and claims.

1. The basis for the adoption of the complaint is proof of purchase of goods (e.g. fiscal receipt or VAT invoice) or other proof of concluding a purchase agreement.
2. A complaint can be submitted on the WOJTYCZKA Complaint Form, the specimen of which can be downloaded from the website of the Internet Shop: Wojtyczkapantofle.pl
3. The complaint will be considered immediately, no later than within 14 calendar days from the date of receipt of the goods under complaint together with a signed and completed set of documents to the address: Tuptuś Wojciech Wojtyczka, ul. Waksmundzka 212, 34-400 Nowy Targ with the annotation “ADVERTISEMENT – online shop”.
4. The Seller is liable under the warranty for physical defects that existed at the time when the danger passed to the buyer or arose from a cause inherent in the sold thing at the same time.
5. If the sold thing has a defect, the buyer may submit a declaration of withdrawal from the contract unless the seller immediately and without excessive inconvenience for the buyer replaces the defective thing with a defect-free one or removes the defect. This restriction shall not apply if the thing has already been replaced or repaired by the Seller or the Seller has failed to fulfil the obligation to replace the thing with a defect-free one or to remove the defect.
6. ) If the Purchaser is a consumer, he/she may, instead of the defect rectification proposed by the Seller, demand the replacement of the item with a defect-free item or, instead of the replacement of the item, demand the removal of the defect, unless bringing the item to conformity with the agreement in the manner chosen by the Purchaser is impossible or would require excessive costs in comparison with the manner proposed by the Seller. When assessing the excessiveness of the costs, the value of the defect-free item, the type and significance of the defect found shall be taken into account, as well as the inconvenience to which other means of satisfaction would expose the Buyer.
7. The reduced price should be in such proportion to the price under the contract in which the value of the thing with the defect remains to the value of the thing without the defect. 8. The buyer may not withdraw from the contract if the defect is insignificant.
9. If the sold goods have a defect, the Buyer may request to replace the goods with defect-free goods or remove the defect.
10. The Seller shall replace the defective item with a defect-free one or remove the defect within a reasonable time without undue inconvenience for the Buyer.
11. ) The Seller may refuse to satisfy the Buyer’s request if bringing the defective item to conformity with the contract in a manner chosen by the Buyer is impossible or would require excessive costs in comparison with the other possible manner of bringing it to conformity with the contract. If the Buyer is an entrepreneur, the seller may refuse to replace the item with a defect-free one or to remove the defect also if the costs of satisfying this obligation exceed the price of the sold item.
12.To the Buyer who is not a consumer, the provisions on the warranty for defects of the Civil Code shall apply accordingly.
13.) Notification of defects (complaint) should include a description of the defect of the goods, the date on which the defect was detected and a statement of the request to remove the defect.
14. In the case of complaints relating to mechanical damage caused during transport, please make an appropriate record of damage in the presence of the deliverer. Then send the purchased goods together with the report to the address indicated in Section 3.
15. In the offices and on the websites of district (city) consumer ombudsmen, social organisations whose statutory tasks include consumer protection, provincial inspectorates of the Trade Inspection and at the following addresses of the Office of Competition and Consumer Protection: www.uokik.gov.pl/spory_konsumenckie.php, there is detailed information on out-of-court procedures for handling complaints and pursuing claims. The rules of access to these procedures are available at:

(16) The Consumer can obtain free assistance in resolving an individual dispute between the Consumer and WOJTYCZKA using free legal assistance of a municipal or district consumer ombudsman or a social organization whose statutory tasks include consumer protection.
The European Consumer Centres Network also assists in resolving an individual dispute and a consumer complaint related to a cross-border transaction. Their addresses are available on the website of the European Consumer Centre: www.konsument.gov.pl.
18. The Consumer has, inter alia, the following possibilities to use out-of-court dispute resolution between the Consumer and WOJTYCZKA:
a) applying to the Provincial Inspector of the Trade Inspection to initiate proceedings for out-of-court dispute resolution,
b) applying to the permanent court of arbitration operating at the Voivodship Inspector of Trade Inspection with a request to settle a dispute resulting from the concluded sales agreement. A list of all provincial inspectorates of the Trade Inspection and permanent arbitration courts, together with the addresses of their websites, can be found on the website of the Office of Competition and Consumer Protection at: www.uokik.gov.pl/wazne_adresy.php. The list of institutions dealing with out-of-court settlement of consumer disputes, together with information on the type of cases dealt with by individual entities, is available on the website of the Office of Competition and Consumer Protection at: www.uokik.gov. pl There is also a contact point at the President of the Office of Competition and Consumer Protection for out-of-court settlement of consumer disputes and an online system for solving consumer disputes, whose tasks include providing assistance to consumers in matters concerning out-of-court settlement of consumer disputes, in particular in disputes arising from cross-border contracts concluded with consumers.
19. A consumer may use the online consumer dispute resolution platform (ODR platform) in accordance with Regulation (EU) No 524/2013 of the European Parliament and of the Council of 21 May 2013 on online dispute resolution for consumer disputes and amending Regulation (EC) No 2006/2004 and Directive 2009/22/EC (Regulation on ODR in consumer disputes). The European ODR platform aims to facilitate the independent, impartial, transparent, effective, quick and fair out-of-court online resolution of disputes between consumers and traders concerning contractual obligations arising from online sales or service contracts concluded between consumers resident in the European Union and traders established in the European Union. 20. The use of available out-of-court ways of dealing with complaints and claims is possible after the completion of the complaint procedure and is voluntary – both parties must agree to the procedure. WOJTYCZKA. in each individual case will separately agree or refuse to use out-of-court dispute resolution with Consumers.

VIII. Personal data protection.

The administrator of the Buyer’s personal data is TUPTUŚ WOJCIECH WOJTYCZKA with its registered office at 212 Waksmundzka Street, in Nowy Targ (34-400), contact: kontakt@wojtyczka.biz. The Seller processes the Buyer’s personal data for the purpose of concluding and performing the sales agreement through the online shop (Article 6(1)(b) RODO), performing services provided electronically, direct marketing (Article 6(1)(f) RODO) and marketing profiling (Article 6(1)(f) RODO). Recipients of the Buyer’s personal data may be: carriers or their intermediaries carrying out the delivery of consignments, providers of electronic or payment card payment services, IT providers, service providers in the area of marketing and analytical activities. The Buyer has the right to object to the processing of data based on Article. 6 (1)(f) RODO. Personal data for marketing purposes will be processed until consent to the processing of personal data is withdrawn, and for profiling purposes until an objection is made. For the rest, personal data will be processed until the termination of the service/sales contract with the Seller and the time necessary to comply with the obligations imposed by law (billing, limitation of claims). The Buyer has the right to request access to his personal data, rectification, deletion or restriction of processing, as well as the right to object to processing, and the right to data portability. In addition, he or she has the right to lodge a complaint with the supervisory authority of the President of the Office for Personal Data Protection. . Provision of personal data is voluntary, and failure to provide data will make it impossible to conclude and perform the agreement and use the WOJTYCZKA Internet Shop.

IX. Final provisions.

1. These Regulations shall come into force on 01.06.2021.
2. The owner of the online shop reserves the right to amend these Terms and Conditions. The change will be made by placing the new content of the Rules and Regulations on the pages of the Internet Shop. Amendments to the current Rules and Regulations or the new content of the Rules and Regulations shall come into effect after 14 days from the date of placing the new content of the Rules and Regulations on the website of the Internet Shop. Customers will be informed of the change to the Terms and Conditions by information placed on the Seller’s website, which will be visible for at least 14 days, and by e-mail (for Customers who have provided their e-mail address). The effective date of the new Terms and Conditions will be unambiguously specified in its content. The change to the Terms and Conditions will not apply to Customers who purchased goods before the change, unless the changes are beneficial to the Customer and the Customer agrees to them.
3. All names of goods or manufacturers mentioned are used for commercial purposes only and are registered Trademarks of the manufacturers.
